What are Overages?
Our firm assists individuals and businesses in their claims for excess proceeds caused by property tax and delinquent mortgage foreclosure sales. Most US states require that a petition be filed within a prescribed period of time following a foreclosure sale for an owner to recover the excess proceeds from the sale. Unfortunately, there is a very tedious, complicated and expensive process to petition the court to claim the surplus funds. If a petition is not filed within the allotted time, then by default, the taxing entities get to keep what is left as a windfall. We work with previously-foreclosed property owners and a team of attorneys to recover the funds rightfully owed them.
We assist clients on a contingency basis, meaning we do not collect fees upfront and we only earn a fee if we are successful in claiming excess proceeds for the previous property owners
How do overages happen?
To start, most tax-defaulted and delinquent mortgage auctions will have overages when properties are sold to individuals, and the bid amount is greater than the back taxes or the loan balance owed. For example, let’s say a property to be auctioned has an assessed value of $75,000 and $5,000 owed in back taxes. The bidding at the auction would start at the amount of the back taxes, which is $5,000. However, aggressive bidders push up the auction sales price to $45,000.
In our example, all $45,000 is paid to the county treasurer at the auction, yet the unpaid taxes were only $5,000. Therefore, an overage of $40,000 is created. By law, the taxing authority is only entitled to the amount of the back taxes. However, the overage remains with the county treasurer for a specified time, before being transferred to permanently to the county.
Counties will then typically make a limited effort to contact the previous owner via letter or postcard. Unfortunately, this correspondence is usually sent to the last known address on file. So, if a homeowner has recently lost their home to a foreclosure sale, there is a high probability they no longer live at that address. In most cases, the previous property owners are unaware that these funds are available.

Unfortunately, the process to petition the courts to reclaim your overages is very complicated, costly and oftentimes out of reach for many previous homeowners. That’s where we come in. We work with a team of researchers and real estate attorneys to gather all the pertinent information on your claim and petition the court in your local jurisdiction to release the surplus funds to you. We cover any attorney fees associated with processing your claim, including court fees, probate filings, lender communication, estate research, chain of title research, notary fees, tax payment history, etc. We do not collect fees up front and only earn our fees when we are successful in securing your surplus funds. Plus, you never have to waste any of your precious time in court.

The governmental agencies we audit typically DO NOT post these accounts online. You are welcome to search your state’s unclaimed money website, but if you find your name there, those are not the funds we’re informing you about. In addition, the claims process is very lengthy and expensive. It often requires an attorney, billed at hundreds of dollars an hour and numerous trips to court. Not to mention dozens of hours of legal research before the claim is even ready for petition. In many cases, the courts may rule against the claimant, resulting in more research and submission of a new petition. Many claims are NOT ruled in favor of the claimant, meaning the out-of-pocket costs to recover the funds do not get recouped.
Most of the assets we locate aren’t available by searching the internet, and it’s unlikely that without the aid of a company like ours, that you’ll be notified of their existence by the agency holding them.
